Letter from the Courthouse: Witness intimidation.

 

Colin,

 

I had jury duty this week. Drew the short straw. I had to go Monday and was dismissed at noon. Tuesday off for 4th of July.

 

Back on Wednesday. About 2:30, they called my number for a panel. It was a criminal case so we had to go across the street to the big courthouse. We stayed until 5pm for the voir dire. We were told to come back at 9:30am the next day to continue. The next day (yesterday) we were then questioned again until late 11:50am.

 

At this time, the judge dismissed us for lunch. He told us they would seat the jury upon our return at 2pm. At about 1:50, the Honorable Jimmie Edwards himself came into the jury lounge. He apologised and told us he had to dismiss us all.

 

He felt we deserved an explanation as we had spent so much time there for nothing. Judge Edwards said he knew the defendant. He has been charged 5 times with armed robbery…it’s his mo.

 

He said that the witness was too afraid to come and testify. Therefore he had to let the defendant go! The witness, he said, was “on the run”. I couldn’t believe it and asked Judge Edward’s why they couldn’t convict without witness testimony as they had a video of the crime. He said that is not enough….even a confession is not enough to convict. That’s crazy…I was unaware of that.

 

I left there so angry. The defendant was probably back on the streets before the jurors got home! I knew I wasn’t going to be picked though. You should have saw the hands that went up when the lawyer asked if we ourselves or a close family member or friend had ever been the victim of a crime.

 

I got so emotional when it was my turn. I started with getting punched in the face when I was four years old. Then I told them about my son being a victim of the knockout game. The lawyer asked me if I think about that crime. And I said “every day of my life!” At this time the Judge said “sufficient” and they thanked me. I said “there’s more….” but they didn’t need any more from me. I knew at this moment that I wouldn’t be picked which was fine with me as I am at work today and if I don’t work I don’t get paid. I don’t know if I could be impartial anyway.

 

I have too much anger in my heart for those type of violent crimes. I wish I could remember the man’s last name so I could casenet him and see his prior.

 

I’m going to do a little research and will get back to you if I find him.

 

I noticed… lots more hands were up than in previous years service for the question of violent crime.
